FBI Tampa Citizens Academy Alumni Association (FBITCAAA) Applies to https://fbitcaaa.org and fbitcaaa.wildapricot.org (the "Site")

These Terms of Use ("Terms") govern your access to and use of the FBI Tampa Citizens Academy Alumni Association ("FBITCAAA," "we," "our," or "us") website (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
The Site is intended for adults age 18 or older. By using the Site, you represent that you are at least 18 years old and able to enter into a binding agreement. Your membership is also subject to the FBITCAAA Membership Policy and Bylaws, which apply in addition to these Terms.
Membership eligibility is limited to graduates of the FBI Citizens Academy who reside within the 18-county area of responsibility of the FBI Tampa Field Office, subject to Board approval and the FBITCAAA Membership Policy.
If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized access or use. We are not liable for any loss arising from your failure to safeguard your credentials.
FBITCAAA is an independent 501(c)(3) nonprofit organization operated by and for graduates of the FBI Tampa Citizens Academy. FBITCAAA is separate and apart from the Federal Bureau of Investigation ("FBI"), the U.S. Department of Justice, and any other government agency. FBITCAAA is not part of, controlled by, funded by, or an agent of the FBI or any government entity.
Nothing on the Site is an official statement of, or is endorsed or sponsored by, the FBI or any government agency, and no content on the Site should be construed as law-enforcement, legal, security, or professional advice. References to the FBI describe the Citizens Academy program from which our members graduated and do not imply any sponsorship, endorsement, or affiliation.
You agree to use the Site lawfully and respectfully. You will not:
You must uphold FBITCAAA's values and comply with all applicable local, state, and federal laws.
You may have the opportunity to submit content to the Site (for example, comments, posts, photos, or event materials). By submitting content, you grant FBITCAAA a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, modify, display, and distribute that content in connection with the Site and FBITCAAA's activities.
You represent and warrant that you own or have the necessary rights to the content you submit and that it does not violate these Terms or any third party's rights. You are solely responsible for the content you submit.
We may, but are not obligated to, review, moderate, or remove any user content at our discretion, and we may remove content or suspend access without notice. If you believe content on the Site infringes your intellectual property rights, contact us at the address in Section 16.
The Site and its content — including the FBITCAAA name, logo, text, graphics, and design — are owned by or licensed to FBITCAAA and are protected by applicable intellectual property laws. We grant you a limited, revocable, non-transferable license to access and use the Site for its intended, non-commercial purpose. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission, except as permitted by law.
The Site may contain links to third-party websites or resources. We provide these links for convenience only and do not endorse and are not responsible for the content, products, privacy practices, or availability of any third-party site. You access third-party sites at your own risk.
Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, and protect your information and is incorporated into these Terms by reference.
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FBITCAAA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any information on the Site is accurate, complete, or current. You use the Site at your own risk.
TO THE FULLEST EXTENT PERMITTED BY LAW, FBITCAAA and its officers, directors, volunteers, and members shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or relating to your use of (or inability to use) the Site, even if advised of the possibility of such damages.
In no event shall FBITCAAA's total aggregate liability arising out of or relating to the Site or these Terms exceed the greater of (a) the total membership dues, if any, you paid to FBITCAAA in the twelve (12) months preceding the event giving rise to the liability, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless FBITCAAA and its officers, directors, volunteers, and members from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your content, your violation of these Terms, or your violation of any law or the rights of any third party.
We may suspend or terminate your membership or access to the Site at any time, with or without notice, for non-compliance with these Terms, failure to pay dues, or any conduct we determine to be detrimental to FBITCAAA. Provisions that by their nature should survive termination — including Sections 5, 6, 9, 10, 11, and 13 — will survive.
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any such dispute shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction and venue of those courts.
We may modify these Terms at any time. Changes take effect when posted to this page with an updated "Last Updated" date. Your continued use of the Site or continued participation in FBITCAAA after changes are posted constitutes your acceptance of the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our consent; we may assign them freely. These Terms, together with the Privacy Policy and Membership Policy, constitute the entire agreement between you and FBITCAAA regarding the Site. You consent to receive notices and communications from us electronically.
Members may benefit from exclusive events, community service opportunities, and educational programs. Active participation is encouraged to enrich the FBITCAAA experience. Benefits are offered at FBITCAAA's discretion and may change over time.
